This Privacy Notice explains how PerformancePoint LLC ("PerformancePoint", "we", "us") collects, uses, and shares personal information when you use FutureProof Me (the "Service").
1. Who We Are
PerformancePoint LLC is the data controller for personal information processed through the Service. Contact us at info@performancepointllc.com.
2. Information We Collect
- Account data: name, email address, hashed password, authentication identifiers.
- Assessment content: resume text, uploaded documents, career goals, passions, motivations, credentials, and other information you enter into the assessment.
- Analysis outputs: AI-generated forecasts, pivot recommendations, development plans, and edits you make to them.
- Organization data: for team plans, organization name, seat assignments, invitations, and license codes.
- Support communications: messages you send us.
- Usage & device data: log data, IP address, browser and device identifiers, pages visited, timestamps.
Payment card details are collected and processed by Paddle as Merchant of Record; we do not receive or store full card numbers.
3. How We Use Your Information
- Provide, operate, and maintain the Service (including generating AI analyses);
- Authenticate you and manage your account and any organization membership;
- Process purchases, subscriptions, and license codes (via Paddle);
- Provide customer support;
- Detect, investigate, and prevent fraud, abuse, and security incidents;
- Improve the Service and develop new features;
- Send transactional communications about your account and purchases;
- Comply with legal obligations.
4. Legal Bases
Where applicable law requires a legal basis, we rely on: performance of a contract (to provide the Service you purchased); legitimate interests (to secure and improve the Service); consent (where required, e.g. certain cookies); and legal obligation.
5. How We Share Information
- Service providers / subprocessors: hosting and infrastructure providers, AI model providers (used to generate your analysis), analytics, email delivery, and support tooling. These providers act on our instructions.
- Merchant of Record: Paddle, for the sale of the Service, subscription management, payments, tax compliance, invoicing, and refunds.
- Your organization: if you use the Service under a team plan, your organization owner/admin can see your membership and license usage (but not the content of your analyses unless you share it).
- Professional advisers: legal, accounting, and similar advisers.
- Authorities: where required by law, court order, or to protect rights and safety.
- Business transfers: in connection with a merger, acquisition, or sale of assets.
We do not sell your personal information.
6. Data Retention
We keep personal information only as long as needed to provide the Service, comply with legal obligations, resolve disputes, and enforce agreements. When no longer needed, we delete or anonymize it. You may request deletion of your account at any time.
7. Your Rights
Depending on your location, you may have the right to access, correct, delete, restrict, or object to processing of your personal information, to data portability, and to withdraw consent. To exercise these rights, email info@performancepointllc.com. Users in the EEA/UK have the right to lodge a complaint with a supervisory authority.
8. Security
We use appropriate technical and organizational measures to protect personal information, including encryption in transit, access controls, and regular review of our infrastructure. No system is perfectly secure; please use a strong, unique password.
9. International Transfers
We are based in the United States. If you access the Service from outside the U.S., your information may be transferred to and processed in the U.S. and other countries. Where required, we rely on appropriate safeguards such as Standard Contractual Clauses.
10. Cookies
We use strictly necessary cookies to run the Service (for example, to keep you signed in) and may use limited analytics cookies to understand usage. You can manage cookies in your browser settings; disabling essential cookies may break parts of the Service.
11. Children
The Service is not directed to children under 16 and we do not knowingly collect their personal information.
12. Changes
We may update this Notice from time to time. Material changes will be posted here with a new "Last updated" date.
