These Terms & Conditions ("Terms") govern your access to and use of the FutureProof Me service (the "Service") provided by PerformancePoint LLC ("PerformancePoint", "we", "our", or "us"). By using the Service, you agree to these Terms.
1. Who You're Contracting With
The Service is provided by PerformancePoint LLC. If you have questions, contact us at info@performancepointllc.com.
2. Acceptance
By creating an account, purchasing a plan, or otherwise using the Service, you agree to be bound by these Terms. If you don't agree, don't use the Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization.
3. The Service
FutureProof Me is an AI-driven career forecasting, mapping, and planning platform. Outputs are informational and intended to support your own career decisions. They are not a guarantee of employment, income, or any specific outcome and do not constitute legal, financial, tax, or medical advice.
4. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Provide accurate information and keep it up to date.
5. Acceptable Use
You agree not to misuse the Service. Specifically, you will not:
- Use the Service for any unlawful, fraudulent, or deceptive purpose;
- Infringe any intellectual property or privacy rights;
- Upload malware, attempt to probe, scan, or breach security, or interfere with the Service;
- Scrape, resell, or redistribute the Service or its outputs without our written permission;
- Reverse engineer, decompile, or attempt to extract source code, except where permitted by law;
- Circumvent usage limits, seat counts, or license controls.
6. AI Outputs
The Service uses large language models to generate forecasts, recommendations, and roadmaps. You are responsible for reviewing outputs before acting on them. Outputs may be inaccurate or incomplete and should not be relied on as a substitute for professional advice. You are responsible for your prompts and for having the rights to any content you submit.
7. Intellectual Property
PerformancePoint retains all right, title, and interest in and to the Service, including all software, content, branding, and documentation. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to use the Service within your purchased plan. You retain ownership of content you submit; you grant us a limited license to host and process that content solely to provide the Service.
8. Payments, Billing, and Merchant of Record
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation, and refund mechanics are governed by the Paddle Checkout Buyer Terms. Subscriptions renew automatically at the end of each billing period until canceled.
9. Suspension and Termination
We may suspend or terminate your access for material breach of these Terms, non-payment, suspected fraud or security risk, or repeated or serious policy violations. On termination, your right to use the Service ends. You may export your data for a reasonable period before deletion.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE FULLEST EXTENT PERMITTED BY LAW, PERFORMANCEPOINT DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE UNINTERRUPTED OR ERROR-FREE OPERATION.
11. Limitation of Liability
To the fullest extent permitted by law, PerformancePoint's aggregate liability for any claims relating to the Service is limited to the fees you paid us in the 12 months before the event giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or lost goodwill. Nothing in these Terms limits liability for fraud, death, or personal injury caused by our negligence, or any other liability that cannot be limited by law.
12. Indemnification
You agree to indemnify and hold PerformancePoint harmless from claims arising out of your content, your use of the Service, or your violation of these Terms.
13. Governing Law
These Terms are governed by the laws of the State of Tennessee, USA, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Tennessee, unless applicable law requires otherwise.
14. Changes
We may update these Terms from time to time. Material changes will be posted here with an updated "Last updated" date. Continued use of the Service after changes take effect constitutes acceptance.
